1. Acceptance of Terms

By downloading, installing, or using the FiFi mobile application (the "App") or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App or the Service.

These Terms constitute a legally binding agreement between you and the operator of the FiFi application ("FiFi", "we", "us", or "our"). Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

2. Description of the Service

FiFi is a fashion discovery application that helps users identify and find clothing items from publicly available social media videos. The Service works generally as follows:

  1. You submit a URL. You voluntarily provide a link to a publicly accessible video from a supported platform (such as Instagram, TikTok, or YouTube).
  2. Automated analysis occurs. The Service may temporarily retrieve publicly accessible media from the submitted URL and analyze a limited number of frames using automated visual analysis systems.
  3. Results are generated. Based on this analysis, FiFi returns product links and shopping results from third-party retailers for visually similar items.

FiFi functions as a search and discovery tool. It is not a video hosting or streaming platform and does not provide functionality to view, download, store, or redistribute third-party video content.

3. Eligibility

You must be at least 13 years of age to use the Service. If you are under the age of majority in your jurisdiction, you may use the Service only with the involvement and consent of a parent or legal guardian.

By using the Service, you represent and warrant that:

  • you meet the minimum age requirement;
  • you have the legal capacity to enter into a binding agreement; and
  • your use of the Service complies with all applicable laws and regulations.

The Service is intended for personal consumer use only.

4. User Responsibilities

You are responsible for your use of the Service and any content you submit to it. You agree to:

  • use the Service only for personal fashion discovery purposes;
  • submit only URLs to content that is publicly accessible;
  • comply with all applicable laws when using the Service; and
  • ensure that your use of the Service does not infringe the rights of any third party.

You are solely responsible for the legality of the URLs you submit.

5. User-Submitted URLs

5.1 Nature of Submitted Content

FiFi allows users to submit links to publicly available videos hosted on third-party platforms. Users do not upload video files directly to FiFi. Instead, users submit URLs pointing to content that is already publicly accessible on the internet.

5.2 Representations and Warranties

By submitting a URL to the Service, you represent and warrant that:

  • the content is publicly accessible and not private, restricted, or paywalled;
  • you have the right to submit the URL for analysis by the Service;
  • submitting the URL does not violate any law, contract, or court order; and
  • the content does not infringe the intellectual property, privacy, or other rights of any third party.

5.3 User Authorization to Process Public Content

By submitting a URL to the Service, you authorize FiFi to access, retrieve, analyze, and process the publicly accessible content located at that URL for the purpose of providing the Service. You represent and warrant that you have the legal right to submit the URL and to grant this authorization.

You agree that FiFi’s automated retrieval and analysis of such publicly accessible content at your request does not constitute unauthorized access, copying, or redistribution of the underlying media. The Service processes publicly accessible information in a manner conceptually similar to search indexing technologies, extracting signals from publicly available content in order to provide discovery and recommendation functionality.

5.4 Processing of Submitted URLs

The Service may temporarily retrieve publicly accessible media from submitted URLs in order to perform automated visual analysis and generate product discovery results. Any such retrieval is performed solely to enable the core functionality of the Service. FiFi does not claim ownership of third-party video content, and all rights in such content remain with the original creators and platform hosts.

6. Platform Terms Compliance

Content processed through FiFi is hosted on third-party platforms such as social media services. You are responsible for ensuring that your use of the Service and any URLs submitted to the Service comply with the terms of service and policies of the platform hosting that content. FiFi is not responsible for violations of third-party platform terms resulting from user activity.

7. Content Indexing and Discovery

FiFi functions as a technology tool for indexing and discovery of publicly accessible visual information. In performing this function:

  • FiFi does not claim ownership of third-party video content;
  • FiFi analyzes publicly accessible media to extract visual signals used for search and recommendations;
  • product matches are generated through automated visual analysis; and
  • FiFi does not act as a publisher, distributor, or host of third-party video content.

Nothing in these Terms grants you any rights in third-party content retrieved or analyzed by the Service.

8. Acceptable Use

You agree not to use the Service in any way that:

  • violates any applicable law or regulation;
  • submits URLs to private, restricted, or non-public content;
  • infringes any intellectual property, privacy, or other rights;
  • interferes with or disrupts the Service or its infrastructure;
  • attempts to reverse engineer or extract the source code of the App;
  • uses automated scripts, bots, or crawlers to submit excessive requests; or
  • uses the Service to build competing services or for unauthorized commercial purposes.

9. Intellectual Property

The FiFi App, including its software, design, trademarks, logos, and underlying technology, is owned by or licensed to the operator of the Service and is protected by intellectual property laws.

10. Third-Party Services

The Service may provide links to products available from third-party retailers. We do not control, endorse, or guarantee any third-party products or services.

11. Automated Systems Disclaimer

The Service relies on automated computer vision and machine learning systems to identify visual attributes and generate product matches. These systems may produce inaccurate, incomplete, or approximate results.

12. Service Availability

The availability and functionality of the Service may depend on third-party platforms and infrastructure providers that we do not control.

13. Copyright and Rights Holder Notice

If you believe that content processed through the Service infringes your intellectual property rights, please contact us with sufficient information to identify the material in question.

14. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE."

15. Limitation of Liability

Our total aggregate liability shall not exceed the greater of:

  • the amount you paid us in the previous twelve months; or
  • £50 GBP

16. Governing Law

These Terms are governed by the laws of England and Wales.
